CAN YOU BUILD A GRANNY FLAT?
determining if you can construct a secondary dwelling

In order to ascertain whether your site is suitable for an affordable luxury Progeny granny flat in Sydney under complying development guidelines, a number of factors need to be considered:

1. Is there a principal dwelling / main residence?

A granny flat must be constructed in conjunction with and on the same lot as the principal dwelling.

2. Is your block within in the following development zones?

(a) R1 General Residential;
(b) R2 Low Density Residential;
(c) R3 Medium Density Residential;
(d) R4 High Density Residential; or
(e) R5 Large lot Residential (which may require a DA)

If yes, then proceed to the next step.

3. Does your site meet the minimum lot requirements for a granny flat?

If your site is larger than 450 square meters then proceed to the next step.

4. Does your site meet the minimum street frontage requirements for a granny flat?

(a) If your site is larger than 450 square meters and less than 900 square metres then does the site have a minimum 12 metre street frontage?
(b) If your site is larger than 900 square metres and less than 1500 square metres then does the site have a minimum street frontage of 15 metres?
(c) If your site is larger than 1200 square metres then does the site have a minimum street frontage of 18 metres?

If yes to any of the above then it is likely that you are able to construct a granny flat under the current regulations.

5. Other factors to take into account

(a) Your granny flat cannot exceed 60 square metres.

(b) Your granny flat must provide at least 24 square metres of private open space (as an alfresco, patio or backyard) and must be accessible from the living room.

(c) External features such as a garage, carport, patio, alfresco, etc does not count towards the 60 square metre rule.

(d) Whether your block has sufficient side access into the backyard.
